West Ham are embroiled in a dispute with Sky Sports after co-owners David Sullivan and David Gold objected to critical comments about the club on the Sunday Supplement programme last weekend.

The club have complained about condemnation of Sullivan and Gold's financial stewardship over their 10 years in charge of West Ham, particularly a remark from one guest that referred to alleged 'hands in the till' and references to relegation battles.

There are no distributable reserves because the club has paid £18,7m in interest over the years to a Mr Gold and a Mr Sullivan.
Plus an unspecified amount of 'administration' costs & fees of one sort or another to Mrs Brady who has full time jobs elsewhere (House of Lords, speaking engagements, The Apprentice etc)

In fact, Sullivan and Gold don’t even take a dividend.

Because they can't legally.

To be able to take a dividend, you need to make a profit (we don't currently) or have distributable reserves (in essence "built up" profits). We don't have any of those.

The journo said something along the lines of (from my recollection) "there's a feeling that people have had their hands in the till there, that players go there for a pay packet and managers go there to get another couple of years on their CV". More a bad choice of phrase rather than an outright accusation of theft/fraud.

They borrowed money, using the the facilities as security.

But that’s not asset stripping. Asset stripping is selling assets to enrich shareholders. In fact, Sullivan and Gold don’t even take a dividend.

It is worrying though because it is an another example of how they can’t compete with richer owners in this league. That is the heart of the issue.

Wolves, Villa, and now Newcastle totally surpass Sullivan and Gold in the way they can benefit their clubs.

Richer owners put in equity or offer interest free loans, Sullivan and Gold increase the leverage by borrowing more. Plus, they make bad decisions.

There is nothing untoward about them. They are just bad decision makers who can’t compete.

Is Sullivan being thin-skinned?

Legally, he has a case. But the optics are not good. Probably better to let it slide as attention is being drawn to the whole thing.

Then again, maybe this isn’t the first time Sky has pissed them off and now he wants to scare them.

Agreed.

Sullivan and Gold would definitely not want to fight a case thorough the courts.

But Sky’s counsel will also probably advise them just to accept the apology and be done with it..... unless there are major damages, which I can’t see.

Camel is dead right in what he says.

The saving grace for Sky is that Sullivan will not want to pursue a case unless he wants all the facts about his ownership brought out in the open via a public defamation case. I doubt he will and nor will he, I suspect, want to spend shedloads on legal fees when the outcomes of such defamation cases are unpredictable.
Furthermore he will stand to get little damages as his reputation is not great.

He will be hoping Sky just buckles at the prospect of being sued so he can claim some sort of victory. If Sky stands its ground he will almost certainly back down.
That's what short-arse gobshites tend to do.

I agree and your last paragraph sums up what Kieran Maguire said on BBC Sport yesterday. He also stated that there is little scope for improving the revenue/ income with the current stadium deal.

Jim, you say it can’t be theft if you own it.

That is not the case. If you own a company but raid the employees pensions, that is theft.

Or steal money illegally, that is theft from the minority shareholders, staff with shares.
